These Terms and Conditions govern your use of nauticalboatclub.com (the “Site”), which is owned and operated by Nautical Boat Clubs, LLC (“Nautical Boat Club,” “we” or “us”), and any text messaging program offered by Nautical Boat Club. By using the Site or opting in to text messages, you agree to these terms.
Nautical Boat Club locations are independently owned and operated franchises. Membership is governed by the membership agreement you sign with your local club. Where that agreement conflicts with these terms, the membership agreement controls.
Text Messaging Program
Program description. When you opt in on our website, you may receive text messages from Nautical Boat Club and your local club at the phone number you provided. The text messaging program is operated by Kemah Boat Club LLC. There are two separate programs, and you choose each one individually:
Consent. Consent to receive text messages is not a condition of purchase or membership. Both opt-ins are optional, and you can submit any form on the Site without checking either box.
Message frequency. Message frequency varies based on your inquiry and activity.
Costs. Message and data rates may apply. Check with your wireless carrier for details about your plan.
Opting out. You can cancel at any time by replying STOP to any message. You’ll receive one confirmation that you’ve been unsubscribed, and no further messages will be sent unless you opt in again.
Help. Reply HELP to any message for assistance, or contact your local club using the phone number and email on its location page. You can also reach us at 833-622-2628 or support@nauticalboatclub.com.
Carriers. Wireless carriers are not liable for delayed or undelivered messages.
Privacy. We do not share mobile phone numbers or text messaging opt-in data with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how we handle your information.
Use of the Site
You agree to use the Site for lawful purposes only and to provide accurate information when you submit a form. You may not attempt to interfere with the Site’s operation or access areas of the Site you are not authorized to use.
Information on the Site
We work to keep fleet, pricing, availability and location details accurate, but they can change without notice and may vary by club. Contact your local club to confirm current details before making a decision.
Intellectual Property
All content on the Site, including text, photography, video, logos and the marks Nautical Boat Club®, Boat Life Without Limits® and Boating Country Club®, belongs to Nautical Boat Clubs, LLC and its licensors. You may not copy, reproduce or use this content without written permission.
Disclaimer and Limitation of Liability
The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Nautical Boat Clubs, LLC and the independently owned club that operates your location are not liable for any indirect, incidental or consequential damages arising from your use of the Site.
Changes to These Terms
We may update these terms from time to time. Changes take effect when posted on this page, and the date above reflects the most recent update.
Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
